When They Don’t Let You Go: The Detention Question
So, what happens if they don’t just let you go? What if they answer with, “You’re being detained”?
This is where you must stay calm and firm. Even if you’re being detained, you still don’t have to answer any questions without your lawyer present. This is key to remember—because once they say you’re being detained, the game changes.
Let’s break down the situation further:
“Am I being detained, or am I free to go?”
If they say you’re being detained, then ask them why. They must articulate a reason for your detention. They can’t just say “we’re detaining you” and leave it at that.
If they don’t have a clear answer or reason, they might be violating your rights.
Don’t Say Anything:
Once they’ve told you that you’re being detained, do not talk to them. You don’t have to provide them with any information unless they’re arresting you. Even if they try to intimidate you or tell you that they have “evidence” against you, stay silent and repeat your rights.
Ask for an Attorney:
You should continue to ask for an attorney. “I would like to speak to my lawyer now,” is the best thing you can say.
Do not let them pressure you into talking further. The moment you invoke your right to counsel, the police are legally required to stop questioning you.
They Can’t Search Without a Warrant:
Remember, they cannot search your home or vehicle without your consent or a valid warrant. Even if they claim they have one, they must show it to you. If they don’t provide it or pressure you into giving consent, do not let them in.
If you’re on the street and they try to stop you, they must also have probable cause or a warrant to search or seize you.
If they decide to search without your consent or violate your rights, don’t engage. Stay calm and keep repeating your request for a lawyer. Do not let them intimidate you. If they do proceed, document everything you can later. Take note of their badge numbers, names, and anything that could be useful for a potential case.
What Happens If They Take You In?
So let’s say the situation escalates further, and they decide to arrest you. What should you do?
First off, you still don’t need to say anything. The police can arrest you, but they can’t force you to talk. If they haven’t read you your Miranda rights yet, you need to ask:
“Am I under arrest? Am I being charged with something?”
If you are arrested, they must read you your Miranda rights, which include:
You have the right to remain silent.
Anything you say can be used against you in court.
You have the right to an attorney.
It’s vital that you understand your right to remain silent at this point. Do not try to explain yourself. Do not try to prove your innocence. Everything you say can and will be used against you. Let your attorney do the talking for you.
If the police continue to question you after you’ve invoked your right to remain silent or requested an attorney, everything they obtain can be thrown out in court.
What About When They Use Force?
What if the police decide to use force against you—whether it’s physical restraint, pepper spray, or even a taser?
The best course of action is to remain calm. Do not resist arrest. While it’s hard to stay composed when your rights are being violated, remember that any physical confrontation could escalate the situation and be used against you. Resisting arrest, even in a situation where your rights are being violated, can lead to additional charges.
What should you do when they use force?
Do not physically resist. It can make things worse for you.
Let them know you are not resisting. Say, “I am not resisting arrest,” but do not engage in further conversation.
Request medical attention immediately if you’re injured. Your lawyer will need to know if you were harmed during the arrest.

While you don’t have to talk to the police, you should document the situation immediately. If you are wrongfully detained or searched, gather as much information as possible:
Write down badge numbers of the officers involved.
Take photos of any injuries or damage to property caused during the arrest or search.
Get contact information from any witnesses to the event, as their testimony could help your case.
Use your phone to record if possible. In many places, recording police activity is legal, and this evidence can be crucial for later legal proceedings.
